Do I Need an Environmental Permit for a Septic Tank?

It’s a fair question – and one we get asked all the time.

The answer is: it depends.

Not every septic tank or treatment plant needs a permit, but the rules are stricter than they used to be – and getting it wrong can land you in hot water later.

If your system discharges into a ditch, stream, or river, the rules depend on what type of system you have.

1. If you have a septic tank discharging directly into a watercourse, you’ll need to either upgrade to a sewage treatment plant or change where the discharge goes – a permit alone won’t be sufficient.
2. If you already have a sewage treatment plant discharging into a watercourse, you’ll only need an Environment Agency permit if your system doesn’t meet the standard general binding rules. If it does meet those rules, no permit is required.

And once you’ve got the permit, that’s not the end of the job. You have to maintain the system correctly and keep records of servicing and emptying. If anything goes wrong down the line, it helps to have proof you’ve followed the rules.

If your system discharges into the ground, like into a soakaway, it’s a bit different.

You might not need a permit if your system discharges under 2,000 litres per day and meets the General Binding Rules. But those rules aren’t always simple, and they’ve changed over the years.

One of the biggest changes is this:

Septic tanks can no longer discharge straight into a watercourse.

If yours does, it needs upgrading – usually to a treatment plant or a new drainage field.

So how do you know if you’re compliant?

That’s where we come in. We normally start with a site visit, do a flow-rate calculation based on the size and use of the house, and then check where the wastewater is actually going.

From there, we can tell you if a permit is required – and if so, help you get one.

Some people don’t bother when selling their home, but it can cause big problems later. We’ve seen buyers back out or knock thousands off the asking price when they find out the system doesn’t comply.
